Revised Whistle-Blower Law Interpretive Bulletin, Effective July 1, 2017

The Division of Personnel Interpretive Bulletin on the Whistle-Blower Law (DOP-B2) has been revised to reflect changes to State law, W. Va. Code §6C-1-6, et seq., effective July 1, 2017. The major changes include an increase of a possible civil fine from $500 to $5,000 for government employers who threaten or retaliate against whistleblowers. It also clarifies that fines are owed by the violators themselves, not their agencies, and that a violation will be considered misconduct and possible grounds for discipline and/or dismissal. The law prohibits firing, threatening, or retaliating against a worker for making a good-faith effort to report wrongdoing or waste.
